Terms of Service

These Terms of Service are the agreement between you and VIA for use of the VIA website and related services.

Last updated: 24 August 2026

1. Agreement

By accessing or using VIA (the “Service”), you agree to these Terms of Service (the “Terms”) and to our Privacy Policy. If you do not agree, do not use the Service.

“VIA”, “we”, “us”, and “our” mean the operator of the Service. “You” means the individual using the Service, or the organisation you represent.

2. The Service

VIA is a platform for an international arts ecosystem. It may include public pages, accounts, festival and gathering administration, applications and review, programmes, and a network of people and organisations.

VIA provides software and hosting. Unless we expressly say otherwise, VIA is not the organiser of a particular festival or gathering, does not make artistic selection decisions for organisers, and is not a party to agreements between applicants and organisers.

3. Eligibility

You must be at least 16 years old to create an account. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

4. Accounts

You are responsible for your account, including the accuracy of information you provide and the confidentiality of your sign-in details. Notify us promptly if you believe your account has been misused.

You may sign in with email and password. You may also link a Google account as an additional sign-in method. You must have the right to use any third-party account you connect.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • impersonate another person or organisation, or misrepresent your affiliation;
  • upload malware or attempt to gain unauthorised access to the Service or other users’ data;
  • scrape, harvest, or systematically copy content except as allowed by ordinary use of the Service or by written permission;
  • interfere with the operation or security of the Service; or
  • post content that is defamatory, harassing, or otherwise inappropriate for an arts and community platform.

6. Your content

You retain ownership of content you submit, including profile information, applications, images, documents, and editorial material (“User Content”). You grant VIA a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and otherwise process User Content solely to operate, secure, and provide the Service.

You confirm that you have all rights needed to submit User Content and to grant this licence, and that User Content does not infringe others’ rights.

7. Applications and submissions

When you apply to a festival, gathering, or other opportunity, you also grant the relevant organiser, reviewers, and staff a licence to access and use your submission for assessment, administration, production, and (where applicable) programme publication, in accordance with that opportunity’s own rules.

Organisers set their own eligibility, deadlines, fees (if any), and selection criteria. VIA does not guarantee that a submission will be received, reviewed, or accepted.

8. Organisations, festivals, and gatherings

If you administer an organisation, festival, or gathering, you are responsible for your own legal compliance, including privacy notices to applicants where required, intellectual-property permissions, and the accuracy of public information you publish on VIA.

Staff permissions and public visibility follow the controls in the Service. Publishing content makes it available to the public.

9. Intellectual property

The Service, including its software, design, trademarks, and original VIA materials, is owned by VIA or its licensors. You may not copy, modify, or create derivative works from the Service except as expressly permitted.

10. Third-party services

The Service may link to or rely on third-party services, including Google sign-in, hosting, storage, and external media. Those services are governed by their own terms. VIA is not responsible for third-party services we do not control.

11. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, VIA disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of liability

To the fullest extent permitted by law, VIA and its operators, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or opportunities, arising from your use of the Service.

Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us to use the Service in the twelve months before the claim, or (b) fifty pounds sterling (£50). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

You will indemnify and hold harmless VIA from claims, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your breach of these Terms, except to the extent caused by VIA’s own wilful misconduct.

14. Suspension and termination

You may stop using the Service at any time. We may suspend or end access if you breach these Terms, if we must do so for legal or security reasons, or if we discontinue the Service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.

15. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. If you continue to use the Service after the updated Terms take effect, you accept the changes, except where applicable law requires additional notice or consent.

16. Governing law

These Terms are governed by the laws applicable where the operator of VIA is established, without regard to conflict-of-law rules. Courts of that jurisdiction will have exclusive jurisdiction, except that you may have additional mandatory rights as a consumer in your country of residence.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and VIA for the Service. If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganisation or transfer of the Service.

18. Contact

Questions about these Terms may be sent to the VIA team through the Service, or using the contact details published on this website.
